LUXON Partner Program Terms

The LUXON Partner Program (the “Program”) is operated by 10272605 MANITOBA LTD., operating as LUXON Construction & Development (“LUXON”, “we”, “us”). All referral rewards are issued by 10272605 MANITOBA LTD. By requesting a referral code or submitting a referral, you (the “Partner”) agree to these Terms.

The Program is open to individuals aged 18 or older and to businesses, including past and current clients, homeowners, real estate professionals, designers, investors, and business owners.

The following are not eligible to earn rewards:

• LUXON employees, subcontractors working on the referred project, and their immediate family members;
• the referred client themselves, or anyone referring their own project or their own company;
• anyone who has been disqualified from the Program.

Partners must request a personal referral code from LUXON. LUXON may approve or decline any request at its discretion. Each code is personal and may not be sold, transferred, or published on coupon or deal websites.

A referral is qualified only when all of the following are true:

1. 1.The referred client is new to LUXON: they have not contacted LUXON, requested an estimate, or worked with LUXON in the 12 months before the referral.
2. 2.The referral code is entered in the referred client’s first project request, or provided to LUXON in writing before the first proposal is issued.
3. 3.The referred client signs a written agreement with LUXON and completes the project.
4. 4.The referred client pays all amounts due under that agreement in full.

If two or more Partners claim the same client, the reward goes to the Partner whose code was submitted first. If LUXON cannot determine who referred the client, LUXON’s decision is final.

The reward is 5% of the final paid project value. The final paid project value is the amount actually paid by the client for the project, excluding GST/PST, permit and municipal fees, client-supplied materials, refunds, credits, and amounts written off.

Approved change orders that are paid by the client are included. Rewards are earned once per project; later separate projects by the same client are not eligible unless LUXON agrees in writing.

Example: a referred client completes and pays for a $100,000 project (before tax). The reward is $100,000 × 5% = $5,000.

Rewards are reviewed and approved by LUXON before payout. Approved rewards are paid within 30 days after LUXON receives the client’s final payment, by Interac e-Transfer, direct deposit, or cheque in Canadian dollars.

For projects paid in stages, the reward is paid once the full project is paid. Rewards may be withheld while a payment is disputed, a deficiency is open, or a holdback period applies.

Before payout, LUXON may request the Partner’s legal name, address, payment details, and tax information, including a Social Insurance Number or Business Number where required. LUXON may issue tax slips (for example, a T4A) as required by the Canada Revenue Agency. The Partner is responsible for reporting rewards and paying any taxes that apply.

If the Partner is a business registered for GST/HST, the Partner may invoice LUXON for the reward plus applicable tax.

No reward is paid for projects that are cancelled, unpaid, refunded, disputed, or not completed. If a reward has been paid and the project is later refunded, charged back, or reduced, LUXON may reduce future rewards or request repayment of the overpaid amount.

Partners may share their code with people they know and on their own social media.

Partners may not:

• present themselves as LUXON employees, agents, or representatives;
• make promises about price, schedule, or quality on LUXON’s behalf;
• use spam, paid search ads on the LUXON name, or misleading claims;
• use LUXON’s logo or branding without written permission.

Partners act independently. Nothing in these Terms creates an employment, agency, or partnership relationship.

LUXON may disqualify a Partner and cancel unpaid rewards for fraud, self-referrals, duplicate or false claims, misleading referrals, or breach of these Terms.

Partners with a client portal account can view submitted referrals and reward status in the portal. Questions may be sent to office@luxon.ca.

Referral information is handled as described in LUXON’s Privacy Policy.

LUXON may modify, pause, or end the Program at any time by posting updated Terms on this page. Rewards for referrals submitted before a change are handled under the Terms in effect at the time of submission.

These Terms are governed by the laws of the Province of Manitoba and the applicable laws of Canada.
